   Reclaim your bank charges!

BREAKING NEWSl

Office of fair trading is taking legal action against banks. All claims will be on hold until the outcome of the court case is known.

............................................

On 5 April 2006, the Office of Fair Trading (OFT) concluded that default charges over £12 are automatically presumed to be unfair. In terms of the Unfair Terms in Consumer Contract Regulations Unfair terms are legally unenforceable.

Experts believe there's no way a £30ish charge, when someone exceeds their overdraft limit or bounces a cheque, is proportionate.

Remember it could simply be 1p over the limit and you're charged, and even if it's more you pay interest anyway. It's their costs we're looking at. Does it really cost £30 for a computer to write and send an automated letter?

Types of overcharges

- Unauthorised overdrafts fees
- Bounced cheque fees
- Refused direct debit and standing  order fee
- Late payments fees on credit and store cards
- Penalties on delayed mortgage payments

We specialise in reclaiming charges made by UK banks and credit card companies.

If you have ever had a Direct Debit not paid, a cheque bounced or exceeded your account or overdraft limit or paid you credit card payment late then you may well have been charged £20 - £40 by your bank. You might have been 'cross' or 'upset' about this at the time but perhaps you would have been even more so if you had realised it may actually be unlawful for them to have made that charge at all.

Excessive bank charges

A recent Office of Fair Trading investigation stated that many charges were not only unfair but also unlawful. This means that you could be legally entitled to reclaim bank charges made for at least the past SIX years.
Already thousands of bank customers have reclaimed millions of pounds worth of unlawful bank charges.

What is an unlawful bank charge?

AUK law does not allow ‘penalty’ clauses.

UK law states that banks can only apply charges which relate to their costs. We do not believe it costs any bank £20 - £40 to not pay a direct debit or cheque (even allowing for the cost of writing you a letter to tell you they have not paid it). If this is the case then in making a £20 - £40 charge, that bank is not recovering its costs, it is FINING you. It is not allowed to do this.

Any Fee charged for exceeding an overdraft or 'bouncing' cheques, direct debits and standing orders could therefore be unlawful.

We can claim back unlawful bank charges for you -
for at least the last 6 years.

We know exactly the process required to get back unlawful bank charges as quickly and efficiently as possible. The process can be frustrating but using our service means you can be sure that you will not suffer any unnecessary expense or delay and that we will 'get the job done'. It is in our interests to act effectively and efficiently, otherwise we do not get paid -
we get your money back as quickly as possible.

• We charge you nothing unless we successfully reclaim your charges
• We save you the time and worry of dealing with your bank and, if necessary, the Court
• We will pay all the costs of pursuing your claim - including Court and legal costs

We operate a no win, no fee service. If we are successful in reclaiming unlawful bank charges then we simply take a percentage of these. Our fee starts from 20%. You pay nothing more - we will pay all legal and Court costs ourselves and recover these from the bank when we win.
