Office of fair trading is taking legal action against banks. All
claims will be on hold until the outcome of the court case is known.

On 5 April 2006, the Office of Fair Trading (OFT) concluded that
default
charges over £12 are automatically presumed to be
unfair. In terms of the Unfair Terms
in Consumer Contract Regulations Unfair terms are legally
unenforceable.
Experts believe there's no way a £30ish charge, when someone exceeds
their overdraft limit or bounces a cheque, is proportionate.
Remember it could simply be 1p over the limit and you're charged,
and even if it's more you pay interest anyway. It's their costs
we're looking at. Does it really cost £30
for a computer to write and send an automated letter?

A recent Office of Fair Trading
investigation stated that many charges were not only unfair but also
unlawful. This means that you could be legally entitled to reclaim
bank charges made for at least the past SIX years.

What is an unlawful bank charge?
AUK law does not allow ‘penalty’
clauses.
UK law states that banks can only apply charges which relate to
their costs. We do not believe it costs any bank £20 - £40 to not
pay a direct debit or cheque (even allowing for the cost of writing
you a letter to tell you they have not paid it). If this is the case
then in making a £20 - £40 charge, that bank is not recovering its
costs, it is FINING you. It is not allowed to do this.
Any Fee charged for exceeding an overdraft or 'bouncing' cheques,
direct debits and standing orders could therefore be unlawful.
